DMCA Policy

Homemade Flour Tortillas is committed to respecting the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

We take copyright infringement seriously. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, please notify our designated Copyright Agent as set forth below.

Filing a DMCA Notice of Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on Homemade Flour Tortillas infringes upon your copyrights, you may submit a written DMCA notice to our designated Copyright Agent. To be effective, the notification must be a written communication that includes substantially the following:

  1.   4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: Please include the URL(s) or other identifying information of the material and the location at which the material appeared before it was removed or access to it was disabled.
  • Your full legal name, physical mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Homemade Flour Tortillas may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your electronic or physical signature.

Upon receipt of a valid counter-notification, we will forward it to the complaining party. If the complaining party does not file an action seeking a court order to restrain the user from engaging in infringing activity within 10-14 business days, the removed material may be replaced or access to it restored.

Homemade Flour Tortillas reserves the right to remove any content at any time without prior notice.
